Terms and Conditions

Introduction
These terms and conditions govern the relationship between you (the buyer/investor) and Eclipse Art Group s.r.o. By using our services, website, or placing an order, you confirm that you have read and agreed to these terms. We reserve the right to update them at any time – the current version is always available on our website.

Transfer of Ownership
Ownership of the artwork passes to the buyer only after full payment of the purchase price (including any transportation, insurance, or storage costs) has been received by the seller, unless otherwise agreed.

Authenticity Guarantee
The seller guarantees the authenticity of each artwork and provides a certificate of authenticity. This certificate, together with the invoice, serves as the basis for verifying the provenance of the artwork in the future.

Risk of Damage or Loss
The risk of damage or loss of the artwork passes to the buyer at the moment of personal collection or at the moment of storage in a depository at the buyer’s request.

Investment Nature of Art
Artworks are often regarded as long-term assets with potential for value appreciation and may serve as an alternative form of capital preservation. However, it is important to bear in mind that the value of art can fluctuate over time depending on various factors, including market developments and the artist’s career. All investment decisions are made by the client at their own discretion.

Framing and Aesthetics
Framing is included in the sale in its “as is” condition. Framing is a subjective and aesthetic matter. Any modifications or changes are at the buyer’s expense.

Transportation and Storage
Transportation and storage are arranged on an individual basis. The buyer is responsible for transportation, insurance, and any customs fees. Upon request, professional depository storage can be arranged (at the buyer’s expense, unless otherwise agreed).

Confidentiality
Each party undertakes not to directly or indirectly disclose, communicate, or otherwise make available any confidential information provided by the other party in connection with these Terms – including, but not limited to, the purchase price. This obligation applies to all forms of communication, whether oral, written, or otherwise, and each party shall take all reasonable measures to maintain the confidentiality of such information.

Right of Withdrawal
The buyer expressly agrees that the ordered artwork is reserved, selected, or modified according to their specific requirements and therefore the right of withdrawal within 14 days under Section 1837 of the Czech Civil Code does not apply.
Each purchase is binding, and the buyer acknowledges that the artwork is created, modified, selected, or reserved based on their explicit request.

Warranty and Claims
Any damage or substantial discrepancies must be reported in writing within 3 calendar days of receiving the artwork. Claims must be supported by photographs or an expert assessment. After this period, the artwork shall be deemed accepted in the condition in which it was delivered.

Intellectual Property
By purchasing an artwork, the buyer does not acquire any rights for its further commercial use. The artwork may only be used for personal, aesthetic, or investment purposes (e.g., inclusion in a private collection or as a store of value).
Any copying, publishing, distribution, printing, commercial presentation, digital reproduction, or other forms of use without the explicit written consent of the artist or rights holder are strictly prohibited.

Delivery / Handover Assurance
Delivery times are indicative, and the seller is not liable for any delays caused by third parties (such as carriers or customs procedures).

Governing Law and Jurisdiction
All relationships are governed by the laws of the Czech Republic. Any disputes shall be resolved before the court with jurisdiction over the seller’s registered office.
